That legal phrase matters because this is an opt-out claim.

The ruling does not amount to a finding that Google violated the law, but it lets the case move toward a full trial on its substance.

Google says it plans to dispute the case strongly. "This is a speculative and opportunistic case - and we will argue against it vigorously," a spokesperson said.

Background and Stakes

Search ads are Google's cash machine, and this claim targets that machine. The case is an opt-out collective proceeding before the Competition Appeal Tribunal, the specialist UK body that handles competition disputes.

Because the claim is opt-out, affected businesses do not need to sign up to be part of the class.
