HOAs Step Up Foreclosures as Budgets Tighten

Nobody buys a home hoping to become friends with the homeowners association. But these days, the HOA is not just sending reminders about lawn height.

A growing number of associations are taking bigger steps, including foreclosure, against owners who fall behind on dues. A report from Fox Business on August 3, 2026 found HOAs nationwide are ramping up collection actions as their own costs climb.

Real estate experts point to three pressures: higher operating expenses, dwindling reserves, and the fear that unpaid assessments could leave an association unable to cover essentials like insurance and repairs. Associations usually pay for shared services with regular dues.

Upkeep, landscaping, common-area repairs, insurance - it all comes out of that pot. When the pot runs low, every missed payment becomes a bigger problem.

In the past, many associations let owners catch up slowly. Now some are skipping straight to lawyers or filing liens the moment an owner misses an assessment payment.

The Numbers Behind the Crackdown

This is not a handful of grumpy boards. The same data shows HOA foreclosures are now happening faster than mortgage foreclosures overall. Benutech Data Insights tracked the earlier stage of this trend.

The firm records liens, which are formal legal claims placed on a home when an owner misses assessments, fees, or fines.

Liens do not end the story. If a lien stays unpaid, it can move to foreclosure in many states, and that makes it the first step on a path that can end with the owner losing the home.

Why Associations Are Stretched Thin

Associations have their own money problems, and they are piling up. Meanwhile, labor, grounds care, repairs, and construction materials all cost more.

Insurance is a major cause. The Foundation for Community Association Research found 93% of surveyed associations saw higher property and casualty insurance premiums.

More than half of those with increases faced jumps between 11% and 25%, and about 10% saw premiums leap past 100%. When the expenses climb and the emergency fund is thin, the association cannot afford to be the friendly one that waits.

All of that tightens budgets and makes on-time collection more important.

What It Means for Homeowners

This is not limited to rundown buildings. The stricter approach shows up across community types, including suburban condo buildings and upscale neighborhoods.

If your home sits inside an HOA, the rules apply to you no matter what your house looks like. Brian Fox, co-founder of property-technology firm Benutech, told The Wall Street Journal: "HOAs are being forced into more aggressive collections to avoid their own financial collapse."

For owners who pay on time, there is another side to watch. If your HOA cannot cover rising insurance and repair bills, it may raise fees or hit you with a special assessment.

If it puts off repairs instead, the deferred maintenance can eventually drag down property values. Either way, the owner who falls behind is no longer just an annoyance.

They are becoming a strain on the budget that every other owner depends on. The practical question for any HOA homeowner is whether their association has enough money to cover the basics before that strain turns into a bigger problem.
